2   CDPHE Fetes Environmental Pacesetters

The Colorado Department of Public Health and Environment (CDPHE) recognized more than 30 companies, individuals and government agencies at a ceremony honoring those who have gone above and beyond regulatory requirements when it comes to protecting the environment. The Oct. 7 celebration at the Denver Museum of Nature and Science feted facilities that have reduced waste streams, cut emissions and implemented a variety of additional pollution prevention methods and technologies. CDPHE recognized winners of its Environmental Achievement Award and Pollution Prevention Champion Award as well as three new members to the Gold Level of the department’s Environmental Leadership Program (ELP).

Work by an Air Quality Control Commission (AQCC) subcommittee to incorporate federal changes to the state’s new source review (NSR) program into the AQCC’s Regulation No. 3 continues at with Nov. 5 and Nov. 30 meetings at the Colorado Department of Public Health and Environment. The revision effort was also the subject of a subcommittee meeting Oct. 21.

The AQCC’s rewrite effort involves the Environmental Protection Agency’s NSR revisions promulgated Dec. 31, 2002. The AQCC’s goal is to embed EPA’s changes into AQCC Regulation No. 3 as well as to re-organize the rule so that it’s easier to understand — always a welcome and laudable effort.

Air Pollution Control Division (APCD) staffers have proposed making substantive and non-substantive changes to AQCC Regulation No. 3. The major substantive change will be to incorporate the new NSR rules. The new NSR rules involve five major changes that apply to major stationary sources: 1) Baseline actual emissions; 2) Actual-to-projected-actual applicability test; 3) Plantwide applicability limits; 4) Clean unit tests; and 5) Pollution control project exclusion.

Currently, the major source NSR provisions are contained in sections IV to XI in Part B of Regulation No. 3. In order to more clearly distinguish these requirements from those applicable to all sources, the APCD is prosing to segregate the major source NSR requirements in Part D of Regulation No. 3. Currently, Part D contains the statements of basis, statutory authority and purpose; those statements will be moved to a new Part F. A new Part E will be reserved for Environmental Management Systems.
